Legislative Brief - Health Care Reform: IRS Q & As on Form W-2 Reporting
Executive Summary
The Patient Protection and Affordable Care Act (PPACA) added Internal Revenue Code (Code) section 6051(a)(14), which requires employers to report the aggregate cost of employer-sponsored group health plan coverage on their employees’ Forms W-2. This requirement was originally effective for the 2011 tax year and the W-2 Forms that would be provided in January 2012. However, the IRS later made reporting optional for 2011.
In April 2011, the Internal Revenue Service (IRS) issued Notice 2011-28, which furthered delayed the reporting requirement for small employers. This notice also contains interim guidance for employers that must include group health coverage information on the 2012 W-2 Forms and those that voluntarily choose to comply for 2011 or 2012.MetLife Employee Benefit Trends Study
The 9th Annual Study of Employee Benefits Trends delivers a clear message to employers: Reprioritize employee loyalty and satisfaction, or economic recovery may arrive with unanticipated setbacks for retention and productivity. This year’s findings reveal a workforce that has grown more dissatisfied and disloyal, to the point where a startling one in three employees hopes to be working elsewhere in the next 12 months. Yet employers continue to believe employees are loyal, and they do not appear to be tuned in to this potential flight risk. Focused on the challenging business environment, employers remain confident of
strong levels of employee job satisfaction and loyalty. A loyal and satisfied workforce is part of the
foundation of business growth. Widening cracks in this foundation may force employers to pay a
price in reduced retention and productivity when the job market improves.Benefit Trends

Legislative Brief: IRS Delays Nondiscrimination Rules for Fully Insured Health Plans
Under the health care reform law, non-grandfathered, fully insured group health plans were set to be subject to federal nondiscrimination rules for the first time. These rules, which have historically applied only to self-insured health plans, prohibit discrimination in favor of highly compensated individuals (HCIs). They are found in Section 105(h) of the Internal Revenue Code (the Code).
